The concept of organized crime, born in the the US at the end of XIX and the beginning of XX century, is nowadays subject to serious criticism. This criticism is based on the problem of guilt - according to the classical principles of rule of law only individuals can be bearers of guilt. On the other hand the appearance of the criminal group as a perpetrator, the description of its identity, the discovery of the relations between the participants and their functions, becomes extremely difficult task for criminal justice institutions.
